THC (tetrahydrocannabinol) is the psychoactive compound found in the cannabis plant. The THC limit value refers to the concentration threshold of THC or its metabolite THC-COOH in the body above which legal, medical, or occupational consequences may apply. These thresholds vary by country, context, and the testing method used.
THC Limit Value in Road Traffic (Germany)
In Germany, the legal THC limit for road traffic was updated in 2024 as part of the cannabis legalization framework. The legislator set a threshold of 3.5 nanograms of THC per milliliter of blood serum (ng/ml). Exceeding this value while driving constitutes an administrative offence.
- Below 3.5 ng/ml THC in blood serum: generally no sanction for sober adults without impairment signs
- Above 3.5 ng/ml: fines, penalty points, and possible driving ban
- Combined use with alcohol: stricter rules apply, even below the limit
- Zero-tolerance rule for novice drivers and those under 21 years of age
THC Limit in Drug Screenings (Urine)
In occupational medicine and drug testing programs, urine is commonly tested for THC-COOH, the primary metabolite of THC. This compound remains detectable in urine for much longer than THC itself remains in the blood.
- Common immunoassay screening cut-off: 50 ng/ml THC-COOH in urine (SAMHSA standard, widely used in Europe as well)
- Confirmatory testing (GC-MS or LC-MS/MS): threshold typically set at 15 ng/ml THC-COOH in urine
- In regular users, THC-COOH can remain detectable in urine for up to 30 days or longer
Factors Affecting THC Levels
How quickly THC and its metabolites are eliminated from the body depends on several factors:
- Frequency of use: occasional users eliminate THC faster than chronic users
- Body fat percentage: THC is fat-soluble and accumulates in fatty tissues
- Metabolism and liver function: influence how quickly THC is broken down
- Amount consumed and potency: higher THC concentrations in the product lead to higher body levels
- Route of administration: smoking, vaporizing, or oral ingestion result in different absorption kinetics
THC Limit Value in Medicine
When it comes to medical cannabis, no uniform THC limit values exist for assessing fitness to drive. Patients using THC-containing medicines must be evaluated individually by a physician. Doctors are required to inform patients about the potential impairment of driving ability.
International Differences
THC limit values differ considerably across countries:
- Germany: 3.5 ng/ml THC in blood serum (since 2024)
- Austria: no fixed threshold; any measurable impairment is punishable
- Switzerland: 1.5 ng/ml THC in blood
- USA: varies by state; commonly 5 ng/ml THC in blood
- Netherlands: 3 ng/ml THC in blood
