What is the German Social Code?

The German Social Code (German: Sozialgesetzbuch, abbreviated SGB) is the primary body of legislation governing social security and welfare in Germany. It consolidates the most important laws relating to social protection into a single, structured legal framework. The Social Code is divided into twelve books, each covering a distinct area of social security – ranging from statutory health insurance and pension insurance to basic income support and social care.

Structure and Organization

The Social Code is organized into twelve books, designated by Roman numerals:

  • SGB I: General Part – overarching principles and general provisions of social law
  • SGB II: Basic Income Support for Jobseekers (Citizens Income / Buergergeld)
  • SGB III: Employment Promotion (e.g., unemployment benefits)
  • SGB IV: Common Provisions for Social Insurance
  • SGB V: Statutory Health Insurance (GKV)
  • SGB VI: Statutory Pension Insurance
  • SGB VII: Statutory Accident Insurance
  • SGB VIII: Child and Youth Welfare
  • SGB IX: Rehabilitation and Participation of Persons with Disabilities

Relevance to Healthcare

For the healthcare sector, the most significant books are SGB V (Statutory Health Insurance) and SGB XI (Social Long-Term Care Insurance). SGB V regulates entitlements to medical treatment, the services provided by statutory health insurers, the authorization of physicians and hospitals, and the rights and obligations of insured persons. SGB XI establishes the framework for long-term care insurance, including the classification of care needs into care levels (Pflegegrade), the range of care benefits available, and the financing of care services.

Rights and Obligations of Insured Persons

The Social Code not only defines the benefits citizens are entitled to, but also their duties of cooperation. Insured persons may, for example, be required to participate in medical measures if this helps to avoid or reduce benefit claims. SGB I also contains general principles such as the right to social counseling and the right to information from social benefit agencies.

Recent Developments

The Social Code is regularly updated by the German legislature to reflect changing social, economic, and medical conditions. Notable recent reforms include the introduction of the Citizens Income Act (Buergergeld-Gesetz) in 2023, which substantially reformed SGB II. The statutory health insurance framework under SGB V has also undergone numerous amendments in recent years, particularly in connection with the digitalization of the healthcare system.
