What is Parental Leave?
Parental leave (German: Elternzeit) is a statutory right in Germany that allows parents to take a leave of absence from work following the birth, adoption, or placement of a child. It is regulated by the Federal Parental Allowance and Parental Leave Act (Bundeselterngeld- und Elternzeitgesetz, BEEG). The primary goal is to enable parents to devote time to caring for their child during the early years of life without losing their job.
Eligibility and Duration
Each parent is individually entitled to up to three years of parental leave per child. This period can be taken any time before the child turns three years old. With the employer's consent, up to 24 months of this leave may be postponed and taken between the child's third and eighth birthday.
- Both parents may take parental leave at the same time or alternately.
- Parental leave can be divided into up to three separate periods.
- Adoptive parents and foster parents are also eligible for parental leave.
- A written request must be submitted to the employer at least seven weeks before the start of parental leave (at least 13 weeks in advance for leave taken after the child's third birthday).
Protection Against Dismissal
During parental leave, parents are protected by a special dismissal protection law. The employer generally cannot terminate the employment contract during this period. This protection begins when the parental leave is formally requested -- at the earliest eight weeks before the intended start date -- and ends on the last day of parental leave.
Parental Allowance and Parental Leave
Alongside parental leave, parents can apply for parental allowance (Elterngeld), a state benefit that partially compensates for lost income during childcare. There are several types:
- Basic Parental Allowance (Basiselterngeld): Paid for a maximum of 14 months between both parents, with a single parent able to receive it for a maximum of 12 months.
- ElterngeldPlus: Allows a longer but halved benefit period, especially suitable for parents working part-time during leave.
- Partnership Bonus: Additional months of benefit when both parents work part-time simultaneously.
Part-Time Work During Parental Leave
It is possible to work part-time during parental leave, provided the working hours do not exceed 30 hours per week. Under certain conditions, parents may have a legal right to request part-time work from their current employer. The employer may only refuse this request for compelling operational reasons.
Health Aspects of Parental Leave
Parental leave has important health and psychosocial implications beyond its legal and financial dimensions. Research shows that active involvement of both parents in early childcare promotes the child's attachment development and strengthens overall family well-being. At the same time, parental leave can be an emotionally and physically challenging period, during which sleep deprivation, shifting role identities, and psychological stress may occur. If signs of postpartum depression or severe exhaustion appear, medical or psychological support should be sought promptly.
Returning to Work
After parental leave ends, parents have the right to return to their previous position or an equivalent role. Early communication with the employer facilitates a smoother reintegration. It is advisable to arrange childcare in advance and explore available support programs for returning to the workforce.
